These Terms are the agreement between you and mailstein for use of the mailstein service. By creating an account or sending email through mailstein, you agree to them. If you're accepting on behalf of a company, you confirm you're authorized to do so.
mailstein is a platform for sending transactional and broadcast email, receiving inbound email, and managing the related domains, contacts, templates and logs. mailstein is currently in early access and provided free of charge; features may change as the product develops.
Email is a shared resource and abuse harms every sender's deliverability. Your use of mailstein is governed by our Acceptable Use Policy. In short, you must:
We may suspend or terminate accounts that violate the AUP or that generate excessive bounce/complaint rates, to protect the platform.
You retain all rights to the content you send and the data you upload. You grant mailstein the limited license needed to process, transmit and store that content solely to provide the service to you, subject to your retention settings and our Privacy Policy. You are responsible for having the rights and consents to send what you send.
mailstein is free during early access. When paid plans are introduced, pricing and billing terms will be presented before you incur any charge, and payment will be handled by Stripe. We'll give reasonable notice of pricing that affects you.
We work to keep mailstein reliable, but during early access the service is provided without a uptime or service-level guarantee. We may modify, suspend or discontinue features. We'll try to give notice of significant changes.
You may stop using mailstein and delete your account at any time (Settings → Team → Danger zone). We may suspend or terminate access for violation of these Terms or the AUP, for legal reasons, or to protect the platform and other users. On termination, your data is deleted in accordance with the Privacy Policy.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that every email will be delivered — final delivery depends on recipient mail providers and factors outside our control.
To the maximum extent permitted by law, mailstein will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amounts you paid us in the 3 months before the claim, or (during free early access) US $100.
You agree to indemnify mailstein against claims arising from your content, your use of the service, or your violation of these Terms, the AUP, or applicable law.
We may update these Terms; we'll change the "last updated" date and, for material changes, notify you through the service. Continued use after changes take effect means you accept them.
